If you’re partially at fault for your injury in an automobile accident yes you can file you can still file a claim uh in Missouri and Illinois we have what’s called comparative fault and just because you’re partially at fault you can still recover minus the percentage of fault that you’re responsible in Missouri even if you’re 90% responsible for the accident you’re still entitled to recover 10% % of your uh of your damages from the other party now in Illinois it’s a little different if you’re 50% or more at fault you’re not entitled to recover but if you’re less than 50% at fault yes those same percentages apply.
